UPDATE: (Friday, May 22, 2:40 p.m. ET) – The legal battle between Sofia Vergara and ex-fiance Nick Loeb over the couple’s frozen embryos has just taken another turn, with the judge hearing the case granting Loeb permission to file a revised complaint that will allow him to seek custody of the embryos.

According to AP, Superior Court Judge Lawrence Cho made the ruling today, with Loeb’s attorneys now able to revise his lawsuit (originally filed in August) to seek a ruling the embryos not be destroyed.

Vergara’s attorney, Fred Silberberg, opposed allowing the amended lawsuit, arguing that Loeb “has failed to state a viable legal claim to the embryos,”; pointing out that Loeb “signed an agreement that both parties needed to consent to what happened to the embryos.”; In addition, Silberberg, accused Loeb of using the lawsuit as a way to raise his profile. “It is almost a sham pleading under the law,”; he said in the hearing

Loeb’s attorney, Christina Goodrich, fired back, arguing that the fate of the embryos “has been a very personal, private struggle”; for Loeb, adding: “He does believe that they are his daughters.”;

Along with her bustling career, Sofia Vergara is having to deal with her ex-fiance in a court battle over frozen embryos and she’s broken her silence on the emotional ordeal this week.

First on Howard Stern, Vergara talked about how Nick Loeb is suing her over two frozen embryos conceived during their relationship in 2013. Her ex wants to keep the embryos and stop her from destroying them, until they reach an agreement.

On Thursday’s “Good Morning America”; she reveals to Amy Robach she hopes it’s the “last time”; she will have to talk about the ongoing legal battle.

Court battles are the last thing Vergara needs to add to her busy schedule, which is already filled with a new fiancé, Joe Manganiello, red carpet appearances and promo tours for her upcoming film “Hot Pursuit”; which hits theatres this week.
