Empire“s Lucious Lyon constantly finds himself under attack by enemies who want to bring him down, and it appears the actor who plays the bombastic rap impresario is facing a threat of his own now that his ex-wife has slapped him with a lawsuit stemming from a 2013 incident in which Terrence Howard allegedly beat up then-spouse Michelle Howard.

According to The Hollywood Reporter, Michelle’s complaint alleges the assault took place while the couple was vacationing in Costa Rica in July 2013, claiming that Terrence “followed Plaintiff into the restroom of the rental house and punched her on the left side of her face. Defendant also grabbed Plaintiff by her neck and pushed her against the bathroom wall and strangled her for several seconds.”;

Michelle’s lawsuit goes on to claim Terrence then “grabbed her neck again and pinned her against the shower glass and her head hit the wall.”; At that point, she says she attempted to flee, which is when the actor’s son-in-law, Billy, attempted to intervene.

“While Billy tried to pry Defendant’s hands from Plaintiff’s neck, Defendant whispered to Plaintiff, “Remember what I told you in Bora Bora? That is what I’m gonna do.'”;

This, states the complaint, refers to a previous conversation in which Terrence allegedly threatened his wife by saying “her body would never leave the island. Plaintiff interpreted the reference to mean that Defendant was going to kill her.”;

Michelle is seeking an unspecified amount in damages, reports THR, claiming assault and battery, intentional and negligent infliction of emotional distress,”; along with defamation, claiming her ex “made false accusations disseminated to the public through the media that Plaintiff had made death threats and other threats against Defendant and his family through various social media accounts.”;

This isn’t the first time that Terrence Howard has faced similar accusations. Back in 2001, he was arrested on charges of assaulting his previous wife, Lori McCommas.

Following the couple’s return from Costa Rica, a judge granted Michelle a restraining order against Terrence.

The couple’s divorce was exceptionally nasty; in May, TMZ reported that Terrence filed court documents accusing Michelle of extortion.

THR has reached out to the actor’s reps for comment, but has so far received no response.
