UPDATE: Subway’s Jared Formally Charged: Distributing Child Porn, Sex Acts With Minors

UPDATE: Wednesday, Aug. 19 (1:33 p.m. ET) – It’s official: the prosecutor in Jared Fogle’s case has announced the disgraced ex-Subway spokesman has been charged with “child pornography distribution and repeatedly engaging in commercial sex acts with minors.”;

In the news release, U.S. Attorney Josh Minkler outlines Fogle’s heinous crimes, stating that Fogle has notified the U.S. District court that he “will plead guilty as charged.”;

“Mr. Fogle has admitted in court pleadings that he received child pornography involving multiple minors living in Indiana and other countries over the course of several years,”; states Minkler in the release. “His child pornography crime began when he learned that alleged co-conspirator Russell Taylor was sexually exploiting a 14-year-old girl in March 2011. At that time, Mr. Fogle did nothing to stop the abuse or report it to authorities, but chose instead to receive and repeatedly view the child pornography involving the girl and those other minors produced by his alleged co-conspirator in the years that followed. In total, Mr. Fogle admitted in court pleadings filed today that his actions caused the sexual victimization of a total of 12 minors in Indiana before his co-conspirator’s arrest in April 2015. He preyed on minor victims who did not have the ability to protect themselves.”

Minkler continues: “Mr. Fogle has also admitted in court papers that he repeatedly traveled to other states to engage in commercial sex acts with victims he knew were underage minors. This criminal conduct began years before his child pornography activities and did not involve Taylor. Such activities have devastating effects in the lives of minors subjected to such sex trafficking. Federal law provides strong punishment for engaging in commercial sex acts with minors under the age of 18 years or producing child pornography involving any minor under the age of 18 years. We will remain steadfast in our dedication to protecting children from offenders like him.”;

The release points out, however, that the facts stated “are allegations only,”; and that at this time Fogle is “presumed innocent until proven guilty beyond a reasonable doubt.”;

Not surprisingly, the sandwich chain that made Fogle famous has unceremoniously severed all ties with its former spokesman, issuing a reminder via Twitter that Subway and Jared have already parted ways:

UPDATE: Wednesday, Aug. 19 (12:54 a.m. ET) – You know the situation is not good when even your own family tries to distance themselves from you, as disgraced former Subway spokesman Jared Fogle is learning today.

“Our family is shocked and profoundly disappointed in Jared’s abhorrent criminal behaviour and we are very concerned for the well being of those affected by his conduct,”; reads a statement attributed to “the Fogle family. “At the same time, we are gratified that Jared is accepting responsibility for what he has done by agreeing to plead guilty to the charges filed today and by volunteering to make restitution to the victims. We are also gratified that he is seeking medical treatment. We hope that he will become healthy again and are confident that after he serves his sentence, he will continue to make amends. We look forward to the day that he rejoins our family and society.”;

The Fogles’ statement concludes: “We will not be granting any media interviews. Our plan is to comfort each other and heal and we ask that the media respect our family’s privacy during this very difficult time.”;

Via a statement from his attorney, Fogle has announced that he’s planning to plead guilty to charges of engaging in sex acts with minors and possessing child porn.

“Jared Fogle is agreeing to plead guilty to the charges filed against him today,”; reads the statement from defence attorney Jeremy Margolis. “In doing so, Jared is accepting responsibility for what he has done. He is also volunteering to make restitution to those affected by his deplorable behaviour. While Jared fully recognizes that such monetary contribution will not undo the harm he has caused, he is hopeful it will assist these individuals as they try to move forward with their lives.”;

The statement continues: “Jared also understands that he requires significant psychiatric medical treatment and counselling. He has already begun that process by being extensively examined by a world-renowned expert in sexual conditions in order to chart a course to recovery. It is Jared’s intent and goal to become healthy again.”;

“Most importantly,”; the statement adds, “Jared understands that he has hurt innocent people, vulnerable people, and his family. He has expressed remorse to me and to his loved ones, and will, when given the opportunity, express that remorse to this court and to the people he has harmed. His intent is to spend the rest of his life making amends.”;

UPDATE: Wednesday, Aug. 19 (11:57 a.m. ET) – At approximately 11:30 a.m. ET, Jared Fogle appeared in an Indianapolis court where he was charged with engaging in sex acts with minors and possessing child pornography.

Fogle is expected to plead guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

U.S. Attorney Josh Minkler will reportedly discuss the case in more detail later today.

Meanwhile, an Indianapolis TV station is reporting that Jared’s wife is planning to divorce the disgraced Subway spokesman.

“Obviously, I am extremely shocked and disappointed by the recent developments involving Jared,”; said Katie Fogle in a statement. “I am in the process of seeking a dissolution of the marriage. My focus is exclusively on the well-being of my children. Neither I nor my family will have any further comment on the matter. I appreciate respect for my family’s privacy during this difficult time.”;

After news that he had cut a plea deal yesterday, former Subway spokesman Jared Fogle is facing some shocking new charges in relation to the FBI raid on his home last month, which go far beyond merely possessing child porn.

According to TMZ, Fogle has been charged with “travel to engage in elicit sexual conduct with minors.”;

Previously it was believed that Fogle’s biggest infraction was possessing child porn, but the case is now substantially more serious. According to the complaint, claims TMZ, “between 2010 and 2013, Fogle traveled between Indiana and NYC to engage in sexual acts with minors.”; The complaint also alleges that Fogle paid for these sexual liaisons.

The complaint allegedly contains the content of text messages that Fogle sent to one of the minors — of which there are 14 — in which he writes that he would accept a 16-year-old girl “while stating that the younger the girl, the better.”;

The complaint also alleges that Fogle asked to be sent pictures of the minor victims, and that the porn found on his computer, confiscated by the FBI in the raid, involved both underage girls and boys.

Fogle is alleged to be in possession of images received from Russell Taylor, the head of Fogle’s foundation, who was arrested in April on child-porn charges and subsequently (unsuccessfully) attempted suicide while in custody. The complaint alleges that Taylor sent Fogle photos and videos (taken from hidden cameras installed in Taylor’s house) of children, some as young as six years old.

The terms of the deal will reportedly see Fogle pleading guilty; he’ll serve at least five years in the slammer and pay $1.4 million in restitution ($100,000 to each of his 14 victims).

TMZ reports that Fogle voluntarily turned himself in to the FBI and is currently being processed.
