Dylan McDermott will not have to worry about facing a criminal court, only the court of public opinion.

The “American Horror Story: Apocolypse” actor was recently accused of sexually assaulting a woman in 1991.

McDermott, 56, will not be charged because the timeline falls “outside the statute of limitations,” according to a Los Angeles County District Attorney Charge Evaluation Worksheet — per People.

“The reporting party alleged that she was the victim of a sexual assault by the suspect in 1991,” the worksheet reads. “The allegation is outside the statute of limitations, therefore, an analysis of the strengths and weaknesses of the evidence is not warranted and prosecution is declined.”

McDermott learned of the allegations last year, according to his rep, but allowed the legal process to play out. “Mr. McDermott learned about these allegations last year and trusted that the process would end exactly as it has,” his rep said.

Ever since Harvey Weinstein was accused of sexual assaults in Oct. 2017 many Hollywood personalities have been accused of sexual misconduct, including Kevin Spacey and Louis C.K.
