The Netflix series Making a Murderer is making waves with petitions to get Steven Avery and Brendan Dassey pardoned by President Obama, but unfortunately, the matter is out of Obama’s hands.

“Since Steven Avery and Brendan Dassey are both state prisoners, the President cannot pardon them. A pardon in this case would need to be issued at the state level by the appropriate authorities,” the official response reads.

“While this case is out of the Administration’s purview, President Obama is committed to restoring the sense of fairness at the heart of our justice system. That’s why he has granted 184 commutations total — more than the last five presidents combined — and has issued 66 pardons over his time in office,” the response continues.

Making a Murderer debuted on Netflix on December 18 and recounts the trial of Steven Avery, who was sent to prison for 18 years after an alleged sexual assault and attempted murder, where he was later exonerated only to be accused and and convicted of another murder.
