New documents and a fresh denial have been presented by Dr. Luke’s legal team as his defamation case against Kesha rages on.
They are working to prove that her initial 2014 filing of alleged sexual assault and battery — the case she dropped back in 2016 — was “categorically” false and are hoping this additional documentation will “absolv[e] him from any wrongdoing.”
According to Billboard, the lengthy statement compiles “published articles, and recollections from family and friends for evidence of contradiction” to the allegation that Dr. Luke (Lukasz Gottwald) drugged and raped Kesha on the night of October 5, 2005.
The paperwork includes their versions of the events that took place that night. As reported by E! News, the two each attended Nicky Hilton Rothschild’s birthday at a Hollywood nightclub, followed by an afterparty at Paris Hilton’s home. After consuming “at least four drinks,” according to the documentation, Kesha threw up in the hostess’s closet and was subsequently kicked out.
“As an act of kindness and to help Kesha, since Kesha had just vomited and was intoxicated, [Dr. Luke] escorted her out and offered to allow her to sleep in his hotel suite, which was only a few blocks away. Kesha slept on the bed in the hotel suite, while Dr. Luke separately slept on the couch. Dr. Luke testified, under oath and in great detail, that he did not have any sexual or physical contact with Kesha.”
The legal team goes on to refute Kesha’s sexual assault claim, calling it “meritless” and “bogus.” They claim that “Kesha maliciously plotted to destroy Dr. Luke’s business and reputation” when he did not agree to her contract terms during negotiations in 2012.
As part of this new submission, both Lady Gaga and Katy Perry are being dragged into this battle once again.
Texts between Gaga and Kesha show the two pop artists’ private conversation concerning Katy Perry. At one point, Kesha says “she’s so mean” while Gaga admits “she makes me angry.”
Lady Gaga took to Twitter to address the “old texts”.
“Katy Perry and I have grown up in the industry together. We’ve gone through both celebrations and differences with each other,” she admits. “We’ve matured, gotten over the past, love each other and share deep respect. Katy is my friend and is truly a kind soul. End of story.”
Perry responded with a sweet tweet, telling Gaga, “Love you too friend.”
Should a judge side with Dr. Luke, Kesha’s alleged smear campaign would cost her an estimated $40 million in damages. But she refuses to back down, and now faces the prospect of the case being put before a jury in the event a summary judgment cannot be reached.
