Taylor Swift cannot shake off this lawsuit.

A lawsuit alleging Swift stole the chorus for “Shake It Off” is back in court thanks to a U.S. federal appeals court, according to Variety. This follows a district judge’s dismissal of the suit in Feb. 2018.
The lawsuit accuses “Shake It Off” of ripping off the 2001 composition “Playas Gon’ Play” by songwriters Sean Hall and Nathan Butler.
Judge Michael Fitzgerald said at the time, “By 2001, American popular culture was heavily steeped in the concepts of players, haters, and player haters… The concept of actors acting in accordance with their essential nature is not at all creative; it is banal.”

It seems the federal appeals court did not agree with Judge Fitzgerald’s assessment. The case was remanded for further proceedings at the district court. Swift’s attorneys will likely seek an alternate case for dismissal.
